Samenvatting
In my view this EU proposal is the last chance to shape a European securitization market with a viable future. Over the last 5 years or so there has been a series of piecemeal reforms with, arguably, a lack of joined up thinking. The creation of a simple transparent and standardized (STS) securitization market is a new approach giving the possibility to build a modular framework to avoid many of the more difficult and internally contradictory existing reforms. It is not my intention to present the details of this EU proposal. Rather, I will focus on those elements which are very positive developments and also on some elements which need further consideration. I intend to express some commendations, cautions and concerns. [This paper speaks as at the date of the conference with certain Addenda.]
