Procedural rules have a well known function: they help assure the enforcement of the law. To this first procedural function, one can add a second, substantive one. In effect, in certain cases, procedural rules borrow the role of the law they help enforce. This borrowing implies the adoption of special rules applicable to each substantive area of law. This is already the case, for instance, in family law. In the law of torts, however, there are very few special rules: why not provide for them more often? The function of reparation of the substantive law may – and must – have an influence on procedural law. It would be desirable to introduce in the Code of Civil Procedure special rules that will pursue the substantive goal of protecting the person claiming reparation. The rules on jurisdiction and on the power of the judge would be at the centre of the reform.
