Résumé
The creation of ‘venues' for dispensing justice has played a crucial role, at the international level, in promoting the principle of the ‘rule of law' and thus in the development of international law as a legal system. However, States are not equal when it comes to enforcing or defending their rights, which directly affects the effectiveness, the legitimacy and the credibility of the whole system. Bringing a claim before an international adjudication body, with the many costs that this entails, can be a significant challenge for States. In recent decades, the costs of international litigation have increased considerably, not least because of the complexification of (new) bodies of law, cases and procedures. The whole raison d'être for establishing an international court system would be jeopardised if financial or human resources solely conditioned access to justice. The establishment of legal aid funds has been seen as a durable solution to mitigate this risk. These mechanisms build on a long-standing principle of solidarity of the international community to provide adequate access to justice for indigent parties. This article aims to bring some light on this topic in the context of the ongoing discussions on reforms to the investor-state dispute settlement system in United Nations Commission on International Trade Law Working Group III. The first part of this article will focus on the already established international legal aid funds that deal primarily with public international law issues and create mechanisms for the benefit of respondent States. The second part will then discuss the genesis of the establishment of an Advisory Centre for International Investment Law project and the current proposal of Working Group III, its limitations potential prospects for providing greater access to justice for States in the ISDS system. It will be argued that the proposal for the creation of Advisory Centre for International Investment, as submitted in July 2021, should be refined and clarified to ensure that this initial objective is achievable.
